Terms Of Service
Estimates & Proposals
All estimates and proposals provided by Catanzaro & Sons are offered free of charge and are valid for thirty (30) days from the date issued unless otherwise stated. Pricing is based on the scope of work outlined in the proposal and may be subject to adjustment if project conditions differ from those originally disclosed or observed.
Any additional work requested by the client that falls outside the original proposal will require a written change order and may result in additional charges.
Acceptance of Proposal
A signed proposal, electronic approval, or deposit payment constitutes acceptance of these Terms of Service and authorizes Catanzaro & Sons to schedule and perform the agreed-upon work.
Scheduling & Project Timeline
Project start dates are tentative and may be affected by weather conditions, material availability, unforeseen site conditions, or scheduling adjustments.
Catanzaro & Sons will make every effort to maintain scheduled start and completion dates but shall not be held liable for delays beyond its reasonable control.
Deposits & Payments
A deposit may be required prior to scheduling certain projects. Deposit amounts will be outlined in the proposal.
Payment schedules may vary depending on project size and duration. Any remaining balance is due upon substantial completion of work unless otherwise specified in writing.
Late payments may be subject to additional fees, finance charges, and collection costs as permitted by law.
Change Orders
Any modifications to the original scope of work must be approved by both parties before additional work is performed.
Verbal requests may require written confirmation before work proceeds. Additional labor, materials, or project time resulting from change orders may increase project costs.
Customer Responsibilities
The property owner or authorized representative agrees to:
Provide reasonable access to work areas.
Remove fragile, valuable, or personal items from work zones.
Ensure utilities such as water and electricity are available during the project.
Secure pets and notify occupants of scheduled work.
Catanzaro & Sons is not responsible for damage to items left within active work areas.
Surface Conditions
Painting and carpentry services are performed based on visible conditions at the time of inspection. Hidden damage, water intrusion, structural deficiencies, mold, rot, insect damage, or other concealed conditions discovered during the project may require additional repairs and costs.
While every effort is made to provide accurate estimates, unforeseen conditions may require revisions to the original proposal.
Paint Colors & Materials
Clients are responsible for final color selections unless otherwise agreed upon in writing.
Catanzaro & Sons is not responsible for dissatisfaction resulting from approved color choices, sheen selections, or manufacturer variations after paint has been applied.
Certain colors, deep tones, bright whites, reds, yellows, and specialty finishes may require additional coats and additional charges.
Weather Conditions
Exterior painting, staining, and related services are dependent upon suitable weather conditions. Work may be delayed, rescheduled, or extended to ensure proper product application and long-term performance.
Warranty
Catanzaro & Sons stands behind the quality of its workmanship and may provide a limited warranty as outlined in the project proposal.
Warranty coverage applies only to workmanship-related defects and does not cover:
Structural movement or settling
Water damage
Moisture intrusion
Roof leaks
Improper maintenance
Acts of nature
Normal wear and tear
Previous coatings failing beneath newly applied coatings
Warranty coverage becomes void if work is altered, repaired, or modified by others without prior written approval.
Lead Paint & Safety Compliance
For properties built prior to 1978, Catanzaro & Sons follows all applicable EPA, OSHA, and Lead-Safe Work Practice requirements.
Additional testing, containment, remediation, or compliance procedures may result in additional project costs when required.
Photography & Marketing
Catanzaro & Sons reserves the right to photograph completed projects for portfolio, marketing, website, social media, and promotional purposes unless otherwise requested in writing by the client before project commencement.
Limitation of Liability
Catanzaro & Sons’ liability shall be limited to the value of the contracted work performed. Under no circumstances shall Catanzaro & Sons be liable for indirect, incidental, consequential, or special damages arising from the project.
Right to Refuse or Terminate Services
Catanzaro & Sons reserves the right to refuse, suspend, or terminate services due to unsafe conditions, non-payment, abusive conduct, restricted site access, or circumstances that prevent work from being performed safely and professionally.
Governing Law
These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of Rhode Island.
By accepting a proposal, signing a contract, or authorizing work to begin, the client acknowledges that they have read, understood, and agreed to these Terms of Service.
